DRAFT for lawyer review: not legal advice, not in use. This text may change before Tizzy launches.
Terms of use
The short version
- Tizzy lets you build and run reality shows played by Tizzies, Tizzy's AI characters, watch other people's, and take part through viewer events.
- You must be 16 or older to have an account, and 18 or older to pay for anything or earn money.
- Shows are rated 16+ · Tizzy rating (our own rating, not an official classification): bleeped swearing, arguments, scuffles, crude humour. No sex, gore, real people or anyone under 18.
- Plans renew every month until you cancel, and you can cancel online any time. Credits and points you buy don't expire while your account is open.
- Nothing in these terms takes away your rights under the Australian Consumer Law or other consumer laws.
1. These terms
These terms are an agreement between you and us about using Tizzy: the tizzy.tv website, the app at app.tizzy.tv, our streams and replays, and our emails. By creating an account or buying anything you agree to them. If you only watch public houses without an account, sections 6, 9 and 14–19 still apply to you.
Other documents form part of these terms:
- the Content rules (Schedule 1 below);
- the Points and viewer-event rules (VIEWER_EVENTS_RULES_v1.md), if you use points, viewer events, votes or a Fan pass;
- the Collectable skins rules (SKINS_RULES_v1.md), if you buy or earn skins for your Tizzies;
- the Creator agreement and, if you qualify, the Founding Creator terms, if you put a house on Stream My House.
Our Privacy policy explains how we handle your information.
2. Who you're dealing with
- If you're in Australia: NB Audio Pty Ltd (ABN 34 641 691 223), PO Box 269, Greenock SA 5360, Australia, trading as Tizzy.
- If you're anywhere else: [Tizzy US Inc.], [address], USA, once formed. Until then, NB Audio Pty Ltd.
Your country is set by what you tell us at sign-up and your card's country at checkout. If you move, contact us; we may need to move your account to the other company (your credits, points and houses move with it).
Tizzy is offered in Australia, the United States, Canada and New Zealand. It isn't offered in the UK or the European Union.
3. Age and accounts
- 16+ to join. You must be at least 16. You tell us your date of birth when you sign up; it must be true. We don't knowingly let anyone under 16 have an account.
- 18+ to pay or earn. If you're 16 or 17 you get a free account (the free trial credits, the free viewer-event queue and voting). Buying plans, credits, points or a Fan pass, and earning through Stream My House, is for people 18 and over. Your account unlocks these on your 18th birthday.
- One person, one account. Keep your sign-in safe and don't share your account. You're responsible for what happens on it. Tell us straight away at [support@tizzy.tv] if someone else uses it.
- Team seats on the Network plan let the account holder invite others; the account holder is responsible for them, and each must be 18+.
- If you're 16 or 17, we encourage you to read these terms with a parent or guardian.
Full sign-up and age wording: AGE_RATING_v2.md.
4. What Tizzy is, and AI
- The characters in Tizzy are called Tizzies. Every Tizzy is an AI character: its look is built from our parts kit, and what it says is written live by AI models (currently Anthropic's Claude). They aren't real people, they aren't based on real people, and nothing they say is a statement of fact or our opinion. They can say things that are wrong, unfair, offensive or unexpected.
- Don't rely on anything a Tizzy says (for example about health, money, law or real people) without checking it yourself.
- You use Tizzy to build and watch shows. You can't use it to get raw access to the AI models, to build a competing product, or to train other AI models.
- We may change which AI models we use. Results vary by model, and we don't promise any particular outcome from a house.

5. Plans and subscriptions
5.1 The plans. Prices are in our price list at [tizzy.tv/pricing]. Today:
| Plan | Price | Credits each month |
|---|---|---|
| Free | US$0 | 3 credits, once, to try Tizzy |
| Starter | US$9.99 a month (A$15 incl. GST) | 30 |
| Producer | US$24.99 a month (A$39 incl. GST) | 90 |
| Studio | US$79 a month (A$125 incl. GST) | 250 |
| Network | US$199 a month (A$309 incl. GST) | 700, including one 24/7 house |
Annual plans are [20%] cheaper and renew every year. Australians always see and pay the GST-inclusive A$ price. US sales tax and Canadian or New Zealand GST/HST are added where they apply and shown before you pay.
5.2 Before you subscribe we'll show you, next to the button: the price, how often you'll be charged, that it renews automatically until you cancel, what's included, that unused monthly credits don't carry over, and how to cancel. You tick to confirm you're 18+ and allowed to use the card. Afterwards we email you the same terms and a direct cancel link.
5.3 Renewal. Your plan renews automatically at the end of each period and we charge your card, until you cancel. For annual plans we'll email you a reminder [15–45] days before renewal.
5.4 Cancelling. Cancel any time in Account → Plan, in a few clicks, with no questions you must answer first. Your plan stays active until the end of the period you've paid for, then stops. You won't be charged again. Credits and points you bought stay in your account.
5.5 Price changes. We'll tell you at least [30] days before a price change applies to you. For a price rise we'll either ask you to agree, or let you cancel and refund the unused part of the period you've paid at the new price, if you cancel within [14] days of the first higher charge.
5.6 Changes to plans. If we change what a plan includes in a way that's worse for you, we'll tell you at least [30] days ahead, and you can cancel with a pro-rata refund of any time you've paid for but not used.
6. Credits
- 1 credit runs one house-day (one day in a house or scenario, with up to 8 Tizzies, on the Standard brain). Bigger casts, premium brains, live mode and voiced clips use more credits, as shown before you start them.
- Monthly plan credits are your plan's allowance for that month. Unused monthly plan credits end when your plan renews, and don't carry over.
- Top-up credits you buy separately don't expire while your account is open.
- Credits are used first from your monthly allowance, then from top-ups.
- Credits are only for use on Tizzy. They aren't money, can't be cashed out, sold or transferred, and have no value outside Tizzy.
- If a house fails because of a fault on our side, we'll return the credits it used.
7. Points, viewer events, votes and Fan passes
These are covered by the Points and viewer-event rules (VIEWER_EVENTS_RULES_v1.md). In short: points are only for bidding on viewer events on Tizzy, you only pay if your event wins and runs, points you buy don't expire while your account is open, and nothing is random. Fan passes renew monthly until cancelled, as in §5.
7A. Collectable skins
Skins are looks for your Tizzies, bought at a price you see first or earned. They're covered by the Collectable skins rules (SKINS_RULES_v1.md). In short: you never pay for a random result, skins are a licence tied to your account (not something you own, trade or cash out), buying is 18+, and your consumer rights apply.
8. Refunds
- Your consumer rights come first. Our services come with guarantees that can't be excluded under the Australian Consumer Law, and you may have similar rights in your country. If Tizzy has a major failure, you can cancel and get a refund of the unused part; for other failures, we'll fix it in a reasonable time or refund you.
- If we close your account when you haven't broken these terms, or if we stop offering Tizzy, we'll refund the unused value of credits and points you bought, and the unused part of any plan or Fan pass you've paid for.
- Viewer events that are refused or don't run within 24 hours get their points back automatically (rules §5). Where the law requires a money refund instead, you'll get one.
- Otherwise, we don't refund a plan or Fan pass for a period that's already started if you simply change your mind, but you can cancel so you aren't charged again.
- To ask for a refund, email [support@tizzy.tv].
9. Content rules
You must follow the Content rules in Schedule 1, in everything you make, type or stream on Tizzy, and when you stream a Tizzy house somewhere else.
10. Your content
- "Your content" means what you put into Tizzy: houses, scenarios, the Tizzies you make (their names, personalities and the looks you choose from our parts kit), pitches, settings, twists, viewer events and names. The parts kit itself stays ours (§11).
- You keep the rights you have in your content. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, adapt, run, show, stream, moderate and promote it, as needed to run and improve Tizzy and to show Tizzy to others (for example featuring a public house). This licence ends when you delete the content or close your account, except for copies already shared in public streams, clips others made, backups for a short time, and records we must keep.
- You promise your content doesn't break the law or anyone's rights (including copyright, trade marks, privacy and reputation).
- Viewer events you type become ours to rewrite and use as a twist; we don't show your exact words.
11. Shows, clips and AI output
- AI output means what the Tizzies say and do in your houses, including personalities our generator writes for you,, and the replays, recaps and clips made from it.
- As between you and us, you may use the output of your own houses: watch, share, stream and clip it. Commercial use of clips (for example monetised videos on YouTube or TikTok) needs a plan that includes a commercial-use licence (Studio and Network), or a Stream My House creator account.
- We own Tizzy itself: the app, the art kit and Tizzy parts kit, the Tizzies and sets we made, our scenarios and formats, the Tizzy name and logo, and our recaps, overlays and narrator. You can't use them outside Tizzy except in your own clips and streams of your houses, with the Tizzy watermark or credit where your plan requires it.
- AI output may not be protected by copyright, and similar output may be generated for other users. We don't promise that you own exclusive rights in it.
- You must keep the AI disclosure on anything you publish (
AI_SAFETY_v2.md§3).
12. Stream My House
If you put a house on public Stream My House, the Creator agreement applies too (and the Founding Creator terms if you qualify). You must be 18 or older and on a plan that includes it.
13. Moderation, reports and enforcement
- Everything in Tizzy is moderated: house setups, pitches, viewer events and every line a Tizzy says are checked automatically, and public houses get a human safety review before their first public stream. We may block, rewrite, pause or remove anything that breaks the Content rules or the law, or that our AI providers' rules don't allow.
- Anyone can report a house, stream, replay or event (see
AI_SAFETY_v2.md§5). - If you break these terms, we may warn you, remove content, stop a house, take away features, suspend or close your account, depending on how serious it is. Where we reasonably can, we'll tell you what we did and why, and you can ask us to look again at [appeals@tizzy.tv]. We may act at once, without notice, where safety or the law requires it.
- If we close your account for a serious breach, you lose access to its houses. Unused bought credits and points are dealt with as the law requires.
14. Using Tizzy fairly
Don't: - try to get around moderation, age checks, limits or our AI providers' safety systems, including by "jailbreaking" or hiding prompts in names or events; - use bots, scripts or many accounts to bid, vote, buy or watch; - buy viewer events or Fan passes for your own house, or get others to, to inflate earnings; - copy, scrape, reverse-engineer or overload Tizzy; - use Tizzy to harass, bully, threaten or impersonate anyone.
15. Changes to Tizzy and to these terms
- We're improving Tizzy all the time and may add, change or remove features. If a change removes something you've paid for, §5.6 and §8 apply.
- We may change these terms. For changes that matter, we'll tell you at least [30] days before they apply (by email or in the app). If you don't agree, you can cancel before they apply and get a refund of any prepaid unused part. Changes needed by law or for safety can apply sooner.
16. Ending your account
- You can close your account any time in Account → Privacy. Unused bought credits and points can't be refunded if you close it yourself, unless the law requires it; we'll warn you before you confirm.
- We may close your account under §13, or if it's been inactive for [3] years after we've emailed you twice; if so, we'll refund the unused value of credits and points you bought.
17. Our responsibility to you
- Consumer guarantees. Nothing in these terms excludes, restricts or changes any right or remedy, or any guarantee, warranty or term, that the law says can't be excluded, including the Australian Consumer Law. Where the law lets us limit our liability for a breach of a guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
- Subject to that:
- Tizzy is provided as it is. AI is unpredictable, and we don't promise any house will run a particular way, or that Tizzy will always be available or free of errors.
- We're not responsible for what Tizzies say, or for other users' content or streams, except to the extent the law makes us responsible.
- We're not liable for loss of profits, revenue or data, or for indirect loss.
- Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or [US$100 / A$150].
- These limits don't apply to loss caused by our fraud, wilful misconduct or gross negligence, or to death or personal injury caused by our negligence, or where the law doesn't allow them.
18. Your responsibility to us
If you're using Tizzy for a business (for example as a creator or studio), you'll cover our reasonable losses and costs from third-party claims caused by your content or your breach of these terms, except to the extent we caused them. This doesn't apply to you as a consumer.
19. Disputes and the law that applies
- Talk to us first: email [support@tizzy.tv] and we'll try to sort it out within [30] days.
- If you're in Australia: the law of [South Australia] applies, and the courts of Australia can hear disputes. You can always go to your state or territory's consumer protection agency or tribunal.
- If you're in the US, Canada or New Zealand: [governing law and forum to be decided: e.g. Delaware law, with consumer protections of your home state or province kept; whether to use arbitration and a class-action waiver].
- Nothing here stops you using the consumer rights, complaint bodies or courts your local law gives you.
20. General
- If part of these terms can't be enforced, the rest still applies.
- We may transfer these terms to another company in our group, or to a buyer of Tizzy, who must keep to them; we'll tell you. You can't transfer your account.
- If we don't enforce a term straight away, we can still enforce it later.
- Notices to you go to your account email; notices to us go to [legal@tizzy.tv].
