DRAFT for lawyer review: not legal advice, not in use. This text may change before Tizzy launches.

Creator agreement

The short version

What you earn. When your house is on Stream My House, we share the money it brings in: 60% of net Fan pass revenue and 50% of net viewer-event and ad revenue from your house (Founding Creators: 70% and 60%). "Net" means after GST or sales tax, payment fees, refunds and chargebacks, and for events a 10% AI allowance. We pay you from our own revenue; viewers pay Tizzy, not you.

Who can join. You must be 18 or older, on a plan that includes Stream My House, and living in Australia, the US, Canada or New Zealand. You can also opt your house into the Random slot on the featured page and earn from its ad pool (Schedule A).

When you're paid. Monthly, once your balance is over [A$50 / US$50], about 30 days after the end of the month: through Stripe in Australia, and through Wise (a bank transfer) everywhere else until Stripe can pay you.

Your part. Keep your house, and anything you say or show while hosting it, within our content rules. Keep the AI label on. Don't buy events or Fan passes for your own house.

Our part. Run and moderate the platform, pay you on time, tell you why if we remove or demonetise a house, and give you [30] days' notice of changes. You can leave any time.

1. The parties and this agreement

  1. This agreement is between you (the creator) and the Tizzy company you deal with under Terms §2: NB Audio Pty Ltd (ABN 34 641 691 223) if you're in Australia; [Tizzy US Inc., once formed] if you're in the US, Canada or New Zealand (until it's formed, NB Audio Pty Ltd).
  2. It adds to the Terms of use, which still apply. If they conflict on Stream My House, this agreement wins; the Founding Creator terms win over both for Founding Creators.
  3. You accept it by ticking the box when you turn on Stream My House. If you're accepting for a business, you confirm you can bind it.

2. Who can be a creator

3. Stream My House

  1. Publishing. You choose which of your houses to put on Stream My House. Before a house's first public stream it gets a safety review by us; we'll tell you if it isn't approved and why.
  2. Public. Published houses can be watched by anyone, with or without an account, and appear in the Stream directory. We decide how the directory is arranged; we don't personalise it to viewers.
  3. Viewer events and Fan passes run in your house under the Points and viewer-event rules. You can turn down any viewer event, and set fewer events than the maximum.
  4. Your credits. Streaming uses your plan's credits as normal. Earnings aren't paid in credits.

4. Content and hosting standards

  1. Your house, its characters, settings and twists must follow the Content rules (Terms Schedule 1).
  2. When you host (your voice, webcam, overlays, titles and chat moderation, on Tizzy or on another platform), what you say and show is your own content and your responsibility. It must also follow the Content rules and the law.
  3. AI label. Keep the AI disclosure and the rating start card in every stream and published clip (AI_SAFETY_v2.md §3, AGE_RATING_v2.md §6), and turn on the platform's synthetic-content and mature-content labels where they exist.
  4. Other platforms. If you stream a Tizzy house on Twitch, YouTube, Kick or elsewhere, follow that platform's rules too, including any rules about linking viewers to paid features on another site. Tizzy isn't responsible for actions those platforms take against your channel.
  5. No real people, no minors, no format copying. Don't name or depict real people (including yourself or your viewers) in a house; don't stream with anyone under 18 on camera as a host; don't present a house as a real show or use real show names.
  6. Honesty. Don't tell viewers that characters are real, that viewer events or votes win prizes, or that points or Fan passes go to you directly.

5. What you earn

Revenue from your house Your share (standard) Founding Creators
Fan passes for your house 60% of net 70% of net
Viewer events: points charged for winning bids in your house 50% of net 60% of net
Ads shown on your house's streams and replays on Tizzy 50% of net 60% of net
Random slot ad pool: your share of the pool by verified viewer-minutes (Schedule A) 50% of your pool share 60% of your pool share
Creator skins: sales of skins you designed with us (SKINS_RULES_v1.md), wherever they're used 50% of net 60% of net

6. What "net" means

For each sale, net is what the viewer paid, less: 1. GST, VAT or sales tax included or collected; 2. payment processing fees for that sale (card, Stripe Billing and Stripe Tax fees), at actual cost or a fixed [5%] if we can't tie fees to the sale; 3. any refund, chargeback or chargeback fee on it; and 4. for viewer events only, an AI and moderation allowance of 10% of the amount after 1–3.

For ads, net is the ad revenue we actually receive for impressions on your house's streams and replays, less any ad-network fees.

We won't add new deductions or raise these without notice under §13.

7. Payment, tax and statements

  1. Statements. Your dashboard shows your earnings by house and by type as they happen, and a monthly statement.
  2. When. We total each calendar month's earnings and pay them about 30 days after the month ends (to allow for refunds and chargebacks), once your unpaid balance is at least [A$50 / US$50]. Smaller balances carry over and are paid once they pass it, or when you leave (§12).
  3. How.
  4. Australia: by Stripe transfer to your Stripe Connect account, in A$.
  5. US, Canada and New Zealand, for now: your earnings build up as a held balance you can see in your dashboard from day one. We pay it monthly (once it passes the minimum) by bank transfer through Wise Business, in US$, C$ or NZ$ to your own bank account; you don't need a Wise account.
  6. Switching to Stripe: when our US company or Stripe's payouts for your country are live, we'll move you to Stripe payouts with [30] days' notice by email. What you earn doesn't change, and your balance moves across in full. Held earnings are never forfeited because of the payout route.
  7. Fees: Stripe's payout fees, and Wise's transfer fee, are paid by us, not taken from your payout (owner, 30 Oct 2026). We convert at the provider's rate at the time of the transfer; your own bank's charges are yours.
  8. Tax.
  9. Australia: give us your ABN, or we may have to withhold tax under the "no ABN" rules. Tell us if you're registered for GST. [Whether we issue recipient-created tax invoices (RCTIs) for GST-registered creators, and how GST applies, is for the accountant].
  10. US: give a W-9 (through Stripe, or to us directly while you're paid through Wise); we issue a Form 1099 where required.
  11. Canada and New Zealand: give a W-8BEN or the local equivalent we ask for.
  12. Australian withholding on overseas payouts: if the law requires us to withhold Australian tax from a payment to you (for example if your share is treated as a royalty), we'll withhold only what's required, tell you, and give you a statement.
  13. You're responsible for your own income tax and any GST/HST registration on your earnings.
  14. Mistakes. If we underpay you, we'll pay the difference in the next payout. If we overpay you, we may take it off your next payouts, after telling you how it happened; we won't take more than [50%] of any one payout for this unless you agree.
  15. Questions about a statement must reach us within [12] months; we keep records for at least 7 years and will show you how we worked out your earnings.

8. Holdbacks

We may hold back earnings that are reasonably in question (for example a fraud or chargeback investigation, or a suspected breach of §9), for as long as needed to check them, but no longer than [90] days unless a law or a payment provider requires longer. We'll tell you what's held and why, and pay what's cleared.

9. Self-dealing and fraud

10. Rights in your house and streams

  1. You keep your rights in your house, characters and settings (Terms §10), and in your own commentary, voice and webcam.
  2. You give us a licence to stream, replay, clip, feature and promote your published houses and their streams on Tizzy and in Tizzy's own marketing and social channels (with credit to you where practical), worldwide and royalty-free, for as long as the house is published and for [12] months after for marketing already made.
  3. Your clips. You can publish and monetise clips and streams of your own houses on other platforms, with the AI label and Tizzy credit (§4.3), under the commercial-use terms of your plan (Terms §11).
  4. Our things. Tizzy's app, art kit, sets, narrator, overlays, name and logo stay ours; you can use them only in streams and clips of your houses.
  5. Creator skins. If you design a skin with us, we'll agree the design in writing first. You give us a worldwide, exclusive licence to make, sell and give out that skin on Tizzy for as long as we offer it, and to show it in our marketing, and you consent to the changes we need to make it work in the parts kit (including under moral rights law). You keep any rights you had in your own original artwork outside Tizzy. Buyers keep their skins if you leave. Your share of sales continues for as long as the skin is sold, even after you stop streaming, unless this agreement ended for your serious breach.

11. Moderation, demonetisation and suspension

  1. We may pause a stream, remove a house from Stream My House, demonetise it (no earnings while it's demonetised), or suspend your creator account, if it breaks the Content rules, this agreement, the law, or our AI providers' rules, or if needed to protect viewers or meet a regulator's demand.
  2. We'll tell you what we did, why, and which rule, and give you a chance to respond and to ask for a review at [appeals@tizzy.tv]. We'll answer within [14] days. Where safety or the law needs us to act at once, we act first and explain straight after.
  3. What we do will be in proportion to the problem: a warning or a single house first, unless the breach is serious or repeated.
  4. Earnings made before a suspension, from content that didn't break the rules, are still paid.
  5. The Random slot has its own, stricter rules (Schedule A §4): a flagged line skips and benches a house from the slot automatically. Being benched from the slot isn't a strike against your account and doesn't affect your normal stream or earnings.

12. Ending this agreement

  1. You can leave any time by turning off Stream My House in your settings. Your houses come off the Stream directory straight away.
  2. We can end it with [30] days' notice for any reason (for example if we change or close Stream My House), or at once for a serious or repeated breach after the process in §11.
  3. After it ends we pay all earnings owed, even under the minimum payout, on the next payment date after the holdback period, unless §9 applies. Clauses that by their nature should continue (payment, tax, licences already used, liability) continue.

13. Changes

We can change this agreement with at least [30] days' notice by email. If you don't agree, you can leave before the change applies and we'll pay what you've earned. We won't apply a change that lowers your revenue share or the meaning of net to earnings already made. For Founding Creators, the Founding Creator terms limit changes further.

14. Responsibility

  1. Each of us is responsible for our own breaches of this agreement.
  2. You'll cover our reasonable losses and costs from claims by others caused by your own hosting content (§4.2) or your breach of the law or this agreement, except to the extent we caused them.
  3. We'll cover your reasonable losses and costs from claims by others that the Tizzy app, art kit or narrator (not your content or the AI output your settings produced) infringes their intellectual property.
  4. Neither of us is liable for the other's indirect loss or lost profits. Our total liability under this agreement in any 12 months is limited to the earnings paid or owed to you in that period, or [A$1,000 / US$1,000], whichever is greater, except for fraud, wilful misconduct, unpaid earnings, or where the law doesn't allow a limit.

15. General
